Draft for review: 12 October 2026
1.1 We will carry out all agreed work with reasonable care and skill, using appropriate materials and competent personnel.
1.2 All electrical work will comply with applicable legislation, building regulations, relevant British Standards and electrical safety requirements.
1.3 We will make reasonable efforts to begin and complete work on the agreed dates. Where delays occur due to circumstances outside our reasonable control, we will inform you and agree revised arrangements where necessary. Your statutory rights concerning delays remain unaffected.
1.4 All work, including additional work and variations, must be accepted by the customer in writing before work commences. Written acceptance may be provided by email or through our electronic quotation acceptance system.
1.5 Following completion, we will provide any electrical certificates, test reports and other documentation required for the work. Our normal administrative procedure is to issue final documentation upon receipt of full payment, except where legislation, applicable regulations or certification scheme requirements require earlier issue.
1.6 We provide a 12-month workmanship callback guarantee from completion. If a fault results from defective workmanship, we will rectify it without additional labour charges. This guarantee does not cover misuse, accidental damage, normal wear and tear, faults in existing installations outside the agreed work, or alterations made by others.
1.7 Manufacturer warranties on supplied equipment will apply according to their terms. This guarantee does not reduce your statutory rights.
2.1 Quotations and estimates
2.1.1 A fixed quotation covers the work specifically described, subject to stated assumptions and exclusions.
2.1.2 An estimate is an indication of likely costs and may change where the actual work required differs from the information available when it was prepared.
2.1.3 Where a quotation or estimate is prepared remotely using photographs, descriptions or other information provided by the customer, it is subject to the accuracy and completeness of that information. Costs may increase or decrease following a site inspection or discovery of previously unidentified conditions.
2.1.4 Unless otherwise stated, quotations remain valid for 30 days.
2.2 Interim payments
2.2.1 Where the contract period exceeds 14 days, we may issue interim invoices or stage-payment requests.
2.2.2 Interim invoices may cover work completed and materials supplied or delivered for the project.
2.2.3 Any deposit or agreed payment schedule will be stated in the quotation or contract.
2.3 Final payments
2.3.1 We will issue a final invoice following completion of the agreed work.
2.3.2 Unless otherwise agreed in writing, payment is due within seven working days of receiving the invoice.
2.3.3 All interim payments already received will be credited against the final invoice.
2.3.4 Where payment is overdue, we may take reasonable steps to recover the outstanding amount, including any interest or recovery costs lawfully recoverable.
2.3.5 We may suspend further work for material non-payment after giving reasonable notice, subject to our legal obligations and any immediate safety requirements.
3.1 You must provide reasonable access to the property and working areas at the agreed times.
3.2 Working areas should be reasonably clear of obstructions, personal belongings and other items that could prevent safe access.
3.3 You must inform us of known hazards, including suspected asbestos, unsafe structures, concealed services or other relevant risks.
3.4 If access is unavailable or conditions prevent safe working, we may need to rearrange the appointment. Any additional charges must be reasonable and will be explained where applicable.
3.5 You must provide access to suitable electricity and other facilities reasonably necessary to carry out the agreed work, unless alternative arrangements have been made.
4.1 If you dispute an invoice, please notify us promptly, explaining the amount disputed and the reasons. We will investigate and seek to resolve the matter fairly.
4.2 Materials supplied by Electro Virium Ltd remain its property until full payment has been received, to the extent that ownership can lawfully be retained.
4.3 This retention of ownership applies only where legally effective and does not give us an automatic right to enter a property or remove materials incorporated into a building.
4.4 Nothing in these terms restricts a consumer's statutory right to challenge defective or incomplete work, seek an appropriate remedy or withhold payment where legally entitled.
5.1 Where work is funded through an insurance claim, grant or other third-party arrangement, the customer remains responsible for payment unless we have expressly agreed otherwise in writing.
5.2 Any arrangement for payment directly from an insurer, local authority or funding provider must be agreed separately in writing.
5.3 We will maintain appropriate insurance for the electrical services we undertake.
6.1 Materials supplied by us will be:
New unless otherwise agreed in writing.
Of satisfactory quality.
Suitable for their intended normal purpose.
Consistent with the agreed specification.
Compliant with applicable standards and legal requirements.
6.2 Materials are subject to availability. If a specified item becomes unavailable, we will discuss a suitable alternative and obtain your written approval where the change affects the agreed specification or price.
6.3 Where customers supply their own materials or equipment, we are not responsible for inherent defects in those products. We remain responsible for exercising reasonable care and skill when assessing their suitability and carrying out any agreed installation.
6.4 We may refuse to install customer-supplied materials that we reasonably consider unsafe, unsuitable or non-compliant.
6.5 Any additional labour or materials required because of defective or unsuitable customer-supplied products will be discussed and agreed in writing before proceeding.
7.1 We may use suitably competent employees or subcontractors to carry out parts of the agreed work.
7.2 Where we subcontract work, Electro Virium Ltd remains responsible for fulfilling its contractual obligations to you.
7.3 Any additional work you wish to commission from our personnel in connection with the project must be arranged through Electro Virium Ltd.
7.4 This does not prevent you from independently engaging other contractors, provided doing so does not interfere with our contractual obligations or create unsafe working conditions.
8.1 We will take reasonable precautions to protect customers, occupants, employees and others affected by our work.
8.2 We will comply with applicable health and safety legislation and relevant electrical safety requirements.
8.3 Where the Construction (Design and Management) Regulations apply, each party must fulfil its relevant legal responsibilities.
8.4 We may suspend or decline work where conditions present an unacceptable safety risk.
8.5 Where an installation presents an immediate danger, we will explain the risk and recommend appropriate action. Any additional chargeable remedial work will require written authorisation, except where action is otherwise permitted or required by law.
9.1 We may subcontract part of the agreed work where appropriate.
9.2 We remain responsible for the quality and contractual performance of work undertaken on our behalf.
9.3 Subcontractors will be expected to follow applicable safety standards and site requirements.
10.1 On completion, we will remove our tools, surplus materials and waste generated by our work, unless otherwise agreed.
10.2 We will leave the working area reasonably clean and tidy.
10.3 Removal of pre-existing waste, customer belongings or materials left by other contractors is excluded unless specifically agreed.
10.4 Plastering, decorating and other making-good work is excluded unless expressly included in the quotation.
11.1 Any work outside the original agreed scope must be described and accepted in writing before it commences.
11.2 We will explain the additional cost or pricing basis and any likely effect on completion dates.
11.3 Written approval may be provided electronically, including through our quotation acceptance system.
11.4 We will not charge for optional additional work that has not been authorised.
11.5 Where unexpected conditions are discovered, we may pause the affected work until the necessary changes have been agreed.
12.1 Customers should notify us as soon as possible if they wish to cancel or rearrange agreed work.
12.2 Where a consumer contract is made at a distance or away from our business premises, statutory cancellation rights may apply, including a
14-day cancellation period where required by law.
12.3 We will provide the applicable cancellation information and any required cancellation form before the customer becomes bound by the contract.
12.4 If you expressly request that services begin during a statutory cancellation period, we may ask you to confirm this separately in writing or electronically. If you subsequently cancel, you may be required to pay a proportionate amount for services already provided, where permitted by law and where the relevant requirements have been met.
12.5 Urgent repairs and maintenance may be subject to specific statutory exceptions. We will explain any applicable exception rather than assume all emergency work is exempt.
12.6 Outside statutory cancellation rights, any proposed cancellation charge must reflect reasonable, demonstrable losses or costs that cannot reasonably be avoided. We will not impose an automatic penalty.
12.7 If we need to cancel or postpone work, we will notify you promptly and offer reasonable alternative arrangements, without affecting your statutory rights.
13.1 If you are dissatisfied with our work or service, please contact us at [email protected] with details of the issue.
13.2 We will acknowledge the complaint within a reasonable period, investigate it and explain our proposed resolution.
13.3 Where work is defective, we will provide any remedy required by applicable consumer law, which may include repeat performance or an appropriate price reduction.
13.4 If a dispute cannot be resolved directly, we will provide information about any applicable complaints or alternative dispute resolution arrangements, including those required by any relevant certification scheme.
14.1 These terms are governed by the laws of England and Wales, subject to any mandatory legal protections applicable to the customer.
14.2 If any provision is found unenforceable, the remaining provisions will continue to apply where legally possible.
14.3 No provision excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.
14.4 Nothing in these terms excludes or limits rights or remedies provided under applicable consumer protection legislation.
14.5 The agreed quotation, specification, written variations and these Terms & Conditions together record the agreed scope and contractual conditions, subject to applicable law.
